For over thirty-five years, Fulton Smith’s practice has primarily focused on insurance-related analysis and litigation. His experience includes risk and coverage analysis, litigation, mediations, arbitrations, trials, and appeals for primary and excess insurers across a wide-range of lines. These include general liability, professional liability, and first-party personal and commercial (builders’ risk and inland marine) lines. Mr. Smith’s efforts include decades of successfully prosecuting large loss international and domestic subrogation recoveries for his insurer-clients.

He has served as trial counsel in high-exposure insurance coverage, bad faith, broker liability, and subrogation jury and bench trials in state and federal courts; and he has repeatedly arbitrated before the International Chamber of Commerce.

Mr. Smith’s diverse practice also includes general commercial litigation and trials arising from commercial tenancy disputes, bodily injury claims, construction defect claims, warranty claims, the defense of municipalities, the California Department of Corrections, and the University of California. He has repeatedly served as an arbitrator/chairman resolving National Futures Association disputes; and was a 2019 Pro Bono Leadership Award Honoree for the San Francisco Bay Area’s non-profit Legal Services for Children organization.
